Will my case have to go into litigation?
The decision to file a lawsuit is entirely up to you. Generally, a lawsuit will need to be filed if the offer made by the insurance company is too low given the extent of your injuries. This can happen under the following circumstances: there is a dispute as to who is at fault for the accident, you have pre-existing injuries, or your file is assigned to an unreasonable adjuster.
